Mäeltküla Industrial Park / Tööstuspark (info eesti keeles)

Mäeltküla Industrial Park is situated in Estonia at a distance of 2.5 km from the Estonian city of Viljandi. We are selling rights of superficies for the industrial estate plots in the Mäeltküla Industrial Park, a fast-developing industrial park owned by the Viljandi rural municipality.

Purposes of plots according to the detailed plan:

  • production building land,
  • storage building land,
  • wholesale land
  • logistics centre land.

In total, we offer right of superficies for 16 plots.

Financing by Citadele, conditions:

  • Financing of up to 80% of the project’s expenses
  • Long repayment deadline – up to 15 years with a personalized repayment schedule
  • You can start repaying the main sum after the project is completed
  • The loan can be secured with various assets – real estate, commercial pledge on other assets, guaranty or surety by KredEx or The Estonian Rural Development Foundation (MES)

Access

Access to the industrial park is very good. Big vehicles can access the area, too. The industrial park is located between the bituminised Viljandi-Rõngu basic road and Viiratsi – Mustapali land road. These roads are connected by the bituminised Iva Road. On plots by the side of the Iva Road functioning production, storage and logistics buildings have been built.

For access to the vacant plots, Viljandi rural municipality is going to build the Tööstuse tee road and a part of the Iva põik road in 2021. As part of the roadworks, an infrastructure required for accessing various services by superficiaries will be built:

  • data communication line,
  • water and sewage line,
  • gas line.

Accession fees will be paid by superficiaries.

Potential service providers are AS Varmata (gas), AS Viljandi Vesi (water and sewage), OÜ Elektrilevi (power network), and Telia AS (data communication).

The Mäeltküla Industrial Park is the only developing industrial park near the city of Viljandi.

As of 2020, there are approx. 17,000 inhabitants in the city of Viljandi, 1,160 in the Viiratsi borough, and 13,600 in the Viljandi rural municipality.

When merging the plots the maximum area occupied by buildings extends to 60% of the plot area and the maximum number of buildings and the maximum area occupied by buildings is the sum of respective numbers and areas of plots to be merged.

Allowed roof slope of buildings 0-15°. The ridge line of buildings should be parallel or crosswise to the planned street.

For the exterior of buildings no obligatory materials have been set out.

Parking should be planned within the plot by the building design, the number of parking lots should be based on EVS 843:2016 Town streets.

The maximum allowed height of fencing is 1.5 m.

At least 15% of the plot area should be greenery. It is recommended that there are as much trees as possible in green zones indicated in the detailed plan drawing. The trees should not limit the visibility on the road. Instead of trees, a hedge or a bush line can be created between plots.

In the green zone indicated in the detailed plan drawing, access roads, internal roads, partial parking, technostructures, and footpaths are allowed in addition to greenery.

The exact greenery solution should be submitted together with the architectural design of the building. On plots south to the solar parks (Iva tee 15) or adjacent to the solar park, the maximum height of greenery is 2 m.

Conditions for acquiring right of superficies on plots*

The acquisition price of the right of superficies is 2 (two) euros per square metre (m2). The right of superficies is assigned for a single fee.

After fulfilment of the conditions of the right of superficies (construction of buildings and issuing an authorisation of use), the superficiary is entitled to acquire the plot for a price equal to the land tax valid at that point of time.

The costs of purchase agreement for acquisition of the right of superficies (usually the notary’s fee and the state fee) will be paid by the buyer.

3. Conditions of the right of superficies

3.1 The right of superficies will be established for a term of 30 (thirty) years. After that, the superficiary is entitled to apply for an extension of the right of superficies under the same conditions until the end of the expected lifetime of the buildings, however, for no longer than 99 years.

3.2 The intended purpose of the right of superficies and the obligations of the superficiary:

3.2.1 The superficiary is obliged to build the land encumbered with the right of superficies according to the conditions set out in the detailed plan of the Mäeltküla Industrial Park (order No. 2-3/1134 „Establishment of the detailed plan for the Mäeltküla Industrial Park“ of the government of the Viljandi Rural Municipality of 20 November 2019). In its building design, the superficiary is obliged to follow the requirements established in the detailed plan.

3.2.2. The preparation and financing of a building design is the responsibility of the superficiary.

3.2.3. A building permit for the building(s) to be erected based on the right of superficies, should be issued within three years from the conclusion of the right of superficies agreement at the latest.

3.2.4. The building(s) to be erected based on the right of superficies should be built (authorisation of use issued) within five years from the conclusion of the right of superficies agreement at the latest. A building is considered erected when an authorisation of use has been issued for it.

3.2.5. The superficiary is responsible for establishing and financing water works, sewage, and other communications required for servicing the building up to the accession point.

3.3 The owner (government of the rural municipality of Viljandi) obliges to establish water and sewage works up to the accession point by the time the plots to be constructed are ready to join, as well as build streets and street lighting.

3.4 The superficiary obliges to ensure the maintenance of the plot.

3.5 All fees related to the land encumbered with the right of superficies will be paid and the real encumbrance in public law will be covered by the superficiary.

3.6 The superficiary will cover all costs related to the conclusion of the right of superficies agreement.

3.7 The right of superficies will not extend to lines, mains or other communications passing the plot and belonging to third parties.

3.8 In the event that the term set out under 3.2.3 for issuing of a building permit for the building(s) is exceeded, the superficiary will pay to the rural municipality government of Viljandi a contractual penalty of 500 (five hundred) euros for each calendar month starting from the month following the term until the issuance of the building permit. The contractual penalty will be paid by the tenth (10) day of each month to the bank account of the rural municipality government of Viljandi.

3.9 In the event that the term set out under 3.2.4 for issuing of authorisation of use for the building(s) is exceeded, the superficiary will pay to the rural government of Viljandi a contractual penalty of 500 (five hundred) euros for each calendar month starting from the month following the term until the issuance of the authorisation of use. The contractual penalty will be paid by the tenth (10) day of each month to the bank account of the rural municipality government of Viljandi.

3.10 In the event that the restoring term set out under 5.1 is exceeded, the superficiary will pay to the rural government of Viljandi a contractual penalty of 500 (five hundred) euros for each calendar month starting from the month following the term until the buildings are restored or new buildings built. The contractual penalty will be paid by the tenth (10) day of each month to the bank account of the rural municipality government of Viljandi.

3.11 Should any obligations of the right of superficies be violated (except 3.2.3., 3.2.4., and 5.1.), the superficiary will pay to the rural government of Viljandi a contractual penalty of 500 (five hundred) euros. The contractual penalty should be paid within 1 calendar month starting from the respective request by the owner.

3.12 For each assignment of the right of superficies, and for encumbering the right of superficies with the real right, an approval of the respective owner of the encumbered immovable is required..

4. Termination of the right of superficies and reversion

4.1. The right of superficies ends after 30 years starting from the registration of the right of superficies. After that, the term can be extended by an agreement between the owner of the immovable and the superficiary until the end of the expected lifetime of the buildings, however, for no longer than 99 years..

4.2. The superficiary is obliged to register the right of superficies on the name of the owner of the immovable if the latter requests it (reversion) and the following conditions are met:

4.2.1. the superficiary has not received the building permit by the term specified under 3.2.3, or

4.2.2. the superficiary has not erected the building(s) by the term specified under 3.2.4 of the present order, or

4.2.3. the superficiary has violated the conditions specified under 3.2.1, or

4.2.4. the superficiary violates its material contractual obligations.

4.3. Upon reversion of the right of superficies, no compensation will be paid to the superficiary by the owner.

5. Restoring obligation

5.1. Upon destruction of the building(s) the superficiary is obliged to restore the building or construct a new building within eighteen (18) months starting from the destruction or demolition.

5.2. The superficiary is obliged to insure the buildings constructed based on the right of superficies. The superficiary is obliged to immediately inform the owner of any insurance cases, as well as of any circumstances that may cause an insurance case.
